After the Obama administration set went too far in seeking to protect college students claiming they were sexually assaulted, “completely eroding” the due process rights of the accused, DeVos seeks to solve the problem and get back to a balanced playing field:
Under Obama-era Title IX rules, there was a sharp rise in men who say they were unfairly accused of sexual assault on college campuses thanks to a lower standard of evidence for finding guilt as “more likely than not,” but both the accused and accusers have complained about shoddy investigations and biased tribunals.
The Title IX law, enacted in 1972, forbids discrimination based on sex in education. It was once seen as a measure to ensure equity in college sports, but after President Barack Obama decried the “rape crisis” on our nation’s campuses, the Department of Education’s Office for Civil Rights (OCR) issued several “Dear Colleague” letters starting in 2011, directing college administrations to tackle the issue – and prove on paper they were doing so – or risk losing their federal funding.
The Trump Administration is set to release their new Title IX regulations on campus sexual misconduct this month, in time for the new semester, and is expected to roll back many of the Obama-era crackdowns that burdened colleges and universities and unfairly punished many accused, according to a preliminary draft obtained by The New York Times.It was back in Fall 2017 that Devos called for replacing Obama-era rules for investigating allegations of sexual violence on campus that “failed too many students” with a more “workable, effective, and fair system.”
“Every survivor of sexual misconduct must be taken seriously. Every student accused of sexual misconduct must know that guilt is not predetermined. These are non-negotiable principles,” DeVos said. “Due process either protects everyone, or it protects no one. The notion that a school must diminish due process rights to better serve the ‘victim’ only creates more victims.”

Liberal Media Refuses To Report That Amber Heard Once Beat Up A Woman

Amber Heard, who has accused estranged husband Johnny Depp of spousal abuse, was slapped with domestic violence charges in 2009 after a fight with her then-girlfriend, according to a report.
Heard and Tasya van Ree got into a row on Sept. 14, 2009, at Seattle-Tacoma International Airport, where she allegedly struck her domestic partner in the arm, TMZ reported.
She was charged with misdemeanor domestic violence but the prosecutor declined to move forward with the case because the two were residents of California, not Seattle, the gossip site reported.
In audio of a court hearing obtained by TMZ, the judge told Heard that prosecutors could refile charges within the two-year statute of limitations — though that did not happen. Heard had changed her name to Amber van Ree when she became the artist’s domestic partner, the Mirror reported. The two broke up three years later.If you're a far-Left loon, all a woman has to do is say she was abused and that makes the alleged abuser guilty...because yunno, a woman would never lie about something as serious as being physically abused. IMO the only thing Johnny Depp is guilty of, is being a straight man who fell for that dopamine and thus made the mistake of marrying a Godless, bisexual skank.

Lawsuit: Woman Swears ‘I Wasn’t Raped,’ University Kicks Out Male Student Anyway

Despite two students swearing up and down that the sex they had was consensual, Colorado State University-Pueblo gave the male student a multi-year suspension for the “sexual assault” anyway.
So alleges former student-athlete Grant Neal, who recently filed a lawsuit against the university. According to the lawsuit, Neal and a female trainer went to the movies and had consensual sex while both were sober. When the female trainer’s co-worker noticed a hickey the following morning, she reportedly misunderstood the female trainer’s explanation and believed she had been sexually assaulted by Neal.
Shortly afterwards, the trainer texted Neal the following, according to the lawsuit:
“One of the other Athletic Training students screwed me over!…She went behind my back and told my AT advisor stuff that wasn’t true!!! I’m trying so hard to fix it all.”
“I miss you & care about you so much Grant! Everything will work out…I promise”The trainer called her coordinator and told her bluntly, “I’m fine and I wasn’t raped.”
She also called her mother to explain that she wasn’t raped, according to the lawsuit. Neal says he even recorded a meeting between the two of them where she made it clear the sex was consensual. Apparently none of it mattered; Colorado State University-Pueblo found him guilty of sexual misconduct anyway and gave him a de facto expulsion.
The University released this statement: “CSU-Pueblo cares deeply about its students and is committed to providing a safe and secure education environment… In light of student-privacy laws, the university is prohibited from commenting about specific student discipline cases. Accordingly, CSU-Pueblo is required by law to refrain from discussing any details of the matter.”

Male Texas College Student Sues Over Possible Expulsion For Alleged Sex Assault

A physics major one semester away from graduation is suing to stop University of Texas-Austin from expelling him based on the unproven accusation he sexually assaulted a woman in a drunken, off-campus encounter.Blame radical feminism and the war on white, male college students by the Left. That's the idea now with these stupid and bias 'Yes means Yes' laws springing up on colleges everywhere, with the goal being to take away any ounce of self-responsibility for women engaging in sexual encounters and placing it all in the government's hands to state what happened without any sense of due process.
In one of the latest cases of male college students turning to the courts after being punished by public universities for being accused of sexual assaults, the 21-year-old man identified as John Doe in legal papers claims the school is violating his Constitutional right to due process. His alleged victim, who did not attend the school, never filed a police report, according to his lawyer, yet the school took action based on her father’s complaint.
“What we’re seeing here is a nationwide movement that has gone too far in what the system sees as victims of campus assaults,” said Brian Roark. "Give us a fair hearing, and we'll deal with the consequences."
Doe, who claims the sex was consensual, is facing a disciplinary hearing that could result in his expulsion, The College Fix reported. He filed the suit about two months ago with the goal of clearing his name.
The alleged incident occurred on March 6, 2015, after a night of heavy drinking at a house party where Doe met two unnamed women, according to the lawsuit. The three spent the night at an off-campus apartment belonging to one of the women, where Doe had sex with one woman that night and the other the next morning, according to the lawsuit.

PEOPLE has obtained 2011 video from a source close to Dr. Luke that shows Kesha, sworn under oath, saying "Dr. Luke never made sexual advances at me."Here's an admitted bipolar singer with all sorts of mental issues, who's not all that talented, whose rape allegation is full of holes, getting all sorts of praise and support from the press, celebrities and fans alike, who care little about facts and keep slandering a man who claims he's innocent all over a record contract she signed years ago. Something's definitely not right with the world.
The 63-second clip features snippets edited together from a June 16, 2011 deposition with Kesha and an October 18, 2011 with her mother, Pebe Sebert.
When asked, "Did you ever have an intimate relationship with Gottwald?" Kesha responded: "No."
Later in the clip, she says, "I know that Dr. Luke never made sexual advances at me," and responds "no" when asked, "Did Dr. Luke ever give you a roofie?"
Pieces of the 2011 deposition first came to light when a judge ordered documents be unsealed in 2014, shortly after Kesha, 28, sued Luke, 42, alleging he drugged and raped her and subjected her to a decade of verbal and emotional abuse.
Luke continues to vehemently deny the rape and abuse allegations. "I didn't rape Kesha and I have never had sex with her. Kesha and I were friends for many years and she was like my little sister," the producer, who's countersuing for breach of contract and defamation, Tweeted on Monday. He continued, "Kesha has denied under oath the horrible allegations now being made against me."

Lying 'Rape Activist' Emma Sulkowicz Threatens to Sue Newsweek For Publishing Accused Student’s Side of the Story

Newsweek‘s front page story, titled “The Other Side of the College Sexual Assault Crisis,” examines the surge in college students being falsely accused of rape after universities began lowering their evidentiary standards to crack down on rape. The centerpiece of the article is the story of Paul Nungesser, a Columbia University student who accused of rape by Sulkowicz.
Even under the lower “preponderance of evidence” standard, Nungesser was cleared of the charge by a Columbia tribunal. But Sulkowicz engaged in a art project/protest where she dragged a mattress across campus until the university expelled him (they never did). Sulkowicz became a media star, but the Newsweek story was one of few that was sympathetic towards Nungesser’s side of the story.
When asked for comment, Sulkowicz responded by threatening legal action: “Paul Nungesser’s complaint is filled with lies…. I want to warn you to be conscientious about what you publish as ‘fact’ for I may work with a lawyer to rectify any inaccuracies and misrepresentations.”

Media Coverage of High School Football Deaths is Sensationalism at Its Worst

If you’ve been following the news over the past few months, no doubt you’ve heard about the recent spate of high school football players killed playing the sport. What was once considered a local tragedy has become a national story as outlets have begun counting each death and weaving a narrative: high school football, once considered a harmless past-time, is claiming more and more lives.RELATED: High school football needs to gear up after deaths
The seventh and most recent death was covered by CNN, CBS, USA Today, NBC, ESPN, Fox News, Sports Illustrated, New York Times, Washington Times, and Yahoo News. Previous deaths were also covered by People, ABC, The Guardian, Reuters, MSNBC, The Washington Post… it’s harder to find a national outlet that hasn’t covered the story. And schools are listening: CBS reports that in the wake of mounting casualties, some schools are closing their football programs all together.
You know it must be scary, because CNN even got its graphics team to animate two CGI football players tackling each other (“Is high school football worth the risk?” the segment asked).
All of which is baffling, given that the frequency of high school football deaths hasn’t increased at all, and death rates remain extremely low.In the past two decades, there were 282 deaths as a result of high school football, or 14.1 annually. This year there’s been seven, about halfway through the season. In short, the rate of football deaths has remained completely constant.
The chances of dying during a high school football game have also always been absurdly low. 1.1 million high schoolers play the sport every year, so even if the rate of death doubled overnight, they’d have about a 0.00001% of dying before the season is out. In fact, high school football isn’t even the deadliest high school sport; it’s less dangerous than water polo, softball, and field hockey, and roughly as dangerous as lacrosse.
What then justifies all the sudden media attention? It should go without saying that every sporting death is a tragedy, especially when the victims are so young. But hundreds of high schoolers die every day of equally tragic causes and fail to make front pages and television screens across the nation. Why should football be singled out?
The simple answer is because right now at the highest level of the sport, there is a massive scandal surrounding the National Football League’s handling of concussions. In a recent study, a whopping 96% of former NFL players’ brains were found to have suffered permanent damage. The league was forced to pay $1 billion in settlements to players who allege they covered up the risks of repeated concussions.

A new book claims that male office workers are now so afraid of being on the receiving end of a sexual harassment case, they are reluctant to mentor, assist, befriend and even hold open doors for female colleagues.
Crushingly, Sex & The Office suggests men now view such ordinary, decent behaviours as “too risky” – and, in what will be a bitter irony for equality campaigners – claims that, as a direct consequence, women are now failing to advance at work.

The book’s author, Kim Elsesser, a research scholar at the University of California, argues that a “sex partition” has sprung up, which impedes women from building the vital network of contacts both within the workplace and socially.
And the author should know about tough working environments: she’s a former equities trader at Morgan Stanley.
Tellingly, Elsesser adds that companies themselves are contributing to this mess, as they are now so terrified of legal action they send staff on sexual harassment training courses, and are duty-bound to follow up on any allegation, however minor.
Ludicrously, Elsesser cites examples of men who have been dragged in by their HR departments for simply opening a door for a female colleague or complimenting her on a new suit. “Stories like these spread around workplaces, instilling a fear that innocent remarks will be misinterpreted,” she says.

Democrat Congressman Jared Polis Says Innocent Men Accused Of Rape Should Be Expelled From Colleges

“I mean, we’re talking about a private institution,” he said. “If I was running one, I might say, ‘Well you know even if there’s a 20-30% chance that this happened, I would want to remove this individual.”
Freedom for Individual Rights in Education policy director Joseph Cohn responded by telling Polis that the sort of standard he was discussing would be highly unlikely to pass the due process requirements that public universities must legally abide by.
“It seems like we ought to provide more of a legal framework then that allows a reasonable likelihood standard or preponderance of evidence standard,” the Colorado Democrat responded. “If there’s ten people who have been accused, and under a reasonable likelihood standard maybe one or two did it, it seems better to get rid of all ten people.”
“We’re not talking about depriving them of life and liberty,” he laughed. “We’re talking about them transferred to another university.” That line earned him a smatter of applause.
“Let’s be clear about this,” Cohn said angrily. “That is not what we’re talking about.” But Polis cut him off and began questioning another witness.
